Protecting the Children

Civil Unions and the Children involved
In those civil unions where dissolution involves same sex child custody and support conflicts, I am prepared and armed to help you and your partner arrives at a peaceable solution through mediation...or to take it to the jury and a final verdict, if necessary. The laws regarding the dissolution of these unions are vague, since there is no official recognition of civil union in the State of New York. However, the Attorney General's office has expressed that in cases of dissolution, civil unions will be recognized and therefore equitable distribution of property, child support and child custody in these cases can be complicated and difficult. For this reason, same sex child custody cases in New York tend to be handled legally much like heterosexual divorces.
Counseling
Family law can be complex because the people involved in divorce or the dissolution of civil unions are often many and varied. In addition, it is sometimes easy for partners to forget that the most favorable outcome is a peaceful resolution that supports loving relationships between the children and both parents. In the presence of bitterness, such a result can seem impossible...but effort to that end can restore healing and security to the children, and eventually to the parents, as well. Divorce and dissolution result in the end of the marriage, but both partners are still parents to the children. Focus in this direction is always beneficial. Especially in those cases involving children, I encourage partners to attend counseling to reduce the tension between them and better contribute constructively to the welfare of the children. The angst and conflict partners experience with the ending of a relationship can make it difficult to keep the wellbeing of the children front and center. Counseling can ease the process, so the children can get the protection and security they need and deserve, and both parties can return to living productive, rewarding lives.
Adoption
Family law has a brighter side, too. The adoption of a child is a joyful application of the law, and yet can produce difficult and painful surprises. With all the ups and downs a couple experiences in anticipation and decision-making, the adoption process is an emotional roller coaster.
